The University of Central Florida (UCF), acting for and on behalf of its Board of Trustees and for the benefit of the Florida Solar Energy Center (FSEC) agrees to archive and report monthly utility energy use for schools in the ___________ school district as provided by the following utilities (enter more as needed):

The sponsor, _________, agrees to pay UCF on a fixed price basis start-up costs of _____________ and one-year maintenance costs of ___________ (due within 30 days of this agreement) based on the cost schedule at utilityreportcards.com. The term of this Agreement shall be from _____________ to _____________ .
UCF will send an informal monthly electronic report card to the list provided by the school district and sponsor. Unless otherwise indicated, the sponsor's name will be featured in the monthly electronic newsletter and on the school district's portion of the utilityreportcards.com web site. This report card will not be tracked by UCF as a formal deliverable.
UCF is not responsible for data not being sent from utilities to UCF or for utility report card electronic newsletters not being received due to incorrect email addresses or recipient filters. UCF is not responsible for the correctness of the data provided to UCF by the utilities.
Either party may terminate this Agreement upon thirty (30) days written notification to the other. In the event of termination, UCF will be reimbursed for all costs incurred and any non-cancelable obligations properly incurred through the date of termination.
UCF assumes any and all risks of personal injury and property damage attributable to the negligent acts or omissions of UCF and its officers, employees, servants, and agents thereof while acting within the scope of their employment by UCF. Sponsor assumes any and all risks of personal injury and property damage attributable to the negligent acts or omissions of Sponsor’s officers, employees, servants, and agents, or other persons acting or engaged to act by Sponsor in furtherance of the obligations of Sponsor under this agreement. UCF warrants and represents that it is self-funded for liability insurance, both public and property, with said protection being applicable to officers, employees, servants, and agents while acting within the scope of their employment by UCF. UCF and Sponsor further agree that nothing contained herein shall be construed or interpreted as (1) denying to either party any remedy or defense available to such party under the laws of the State of Florida: (2) the consent of the State of Florida or its agents and agencies to be sued; or (3) a waiver of sovereign immunity of the State Florida beyond the waiver provided in Section 768.28, Florida Statutes.
